East Fork Justice Court, Minden

Call (530) 545-3006Theodore FitzGerald, licensed in Nevada and California

A criminal case from Minden, Gardnerville, Genoa, or anywhere else in the Carson Valley starts in the East Fork Justice Court, and this court is specific about remote appearances: a written request at least 48 hours before the hearing, and until the court approves it, you are expected in the courtroom. A misdemeanor is decided here. A felony or gross misdemeanor gets its preliminary hearing here and, if it goes forward, moves to the Ninth Judicial District Court, which sits in the same building.

I’m Theodore FitzGerald, a criminal defense lawyer in Stateline. I work from one rule: the government has to follow the law at every step, in Minden as at the lake.

Which arrests go to the East Fork Justice Court?

The court describes itself as “a limited jurisdiction court for the East Fork Township of Douglas County, Nevada.” The township is the part of the county outside the Lake Tahoe basin: the Carson Valley and the Topaz Lake (Antelope Valley) area, including Gardnerville, Minden, Genoa, Johnson Lane, Indian Hills, Gardnerville Ranchos, and Topaz Ranch Estates, along with the Pine Nut Mountains and the Eastern Sierra foothills below the basin.

An arrest at the lake (in Stateline, at the casinos, or on Kingsbury Grade below the summit) goes to the Tahoe Justice Court instead. Douglas County is a single judicial district, the Ninth, so both justice courts send their felony cases to the same district court.

What the court decides, and what goes to the district court

Nevada’s justice courts have jurisdiction over misdemeanors and, apart from narrow statutory exceptions, no other crimes. A misdemeanor carries up to 6 months in county jail and a $1,000 fine unless the statute for the offense sets a different penalty. A first or second DUI within seven years is a misdemeanor, and so is a first or second domestic battery within seven years that did not involve strangulation or substantial bodily harm. Those cases are arraigned, litigated, tried, and sentenced in East Fork. See DUI Defense in Stateline and Douglas County and Domestic Battery in Douglas County, Nevada.

The court cannot try a gross misdemeanor or a felony, and it does not take a plea on one. The judge holds a preliminary hearing, within 15 days unless the defendant waives it or the judge extends the time for good cause. It is the first time the State has to put witnesses on the stand and the defense can cross-examine them. If the evidence shows probable cause that the offense was committed and that the defendant committed it, the case is sent to the Ninth Judicial District Court; if not, the defendant is discharged. A waiver sends the case up immediately and gives up that first cross-examination.

What happens at the first court date?

The court calls the first date on a misdemeanor an arraignment and the first date on a felony or gross misdemeanor a first appearance. Its stated purpose is to advise you of your rights under the Nevada and United States Constitutions, tell you the charges, give you a copy of the complaint, take a plea if the case is a misdemeanor, and set the next date.

Before a misdemeanor plea, Nevada law has the court consider whether the case qualifies for preprosecution diversion. Misdemeanor DUI and domestic battery charges do not.

Anyone arrested and held is owed a pretrial release hearing within 48 hours, in open court or by video. See Bail, Custody, and Getting Out of the Douglas County Jail.

Can I appear by Zoom in East Fork?

East Fork publishes a specific procedure:

  • “Parties/counsel desiring to appear by Zoom must file a written request” at least 48 hours before the hearing, in person at the clerk’s office, by fax, or by mail.
  • The form has to be complete, including your contact information, or the request may be denied.
  • The court notifies you of its decision, and “until you receive an approval order from the court, your appearance at the hearing in person is required and anticipated.”

The court’s FAQ also says it “offers video conferencing for parties who do not live locally.” Separately, Nevada law allows a court, with a defendant’s written consent, to take the arraignment, plea, trial, and sentencing on a misdemeanor in the defendant’s absence, once it is satisfied the defendant understood the rights involved. The statute says the court may do this. Whether it does is the court’s decision, case by case.

When a remote appearance is approved, treat it like a courtroom. Use a quiet room, a working camera and microphone, and dress as you would for court. In my experience judges notice, and a clean remote appearance makes the next request easier to grant.

What happens if I miss a court date in East Fork?

When a defendant misses a misdemeanor date without an excuse, Nevada law requires the court to order an arrest warrant within 14 judicial days. Failing to appear is also its own crime unless the person surrenders within 30 days: a misdemeanor when the underlying case is a misdemeanor, and a category D felony if the person left Nevada to avoid prosecution.

The court’s FAQ describes the right way to move a criminal date: a written agreement with the District Attorney’s Office, or a timely written motion. If there is a written stipulation, the court should have a copy before the appearance.

Working with FitzGerald Law in the Carson Valley

My office is in Stateline, and I take cases in both of Douglas County’s justice courts. On an East Fork case, my office files the Zoom request inside the court’s 48-hour window where a remote appearance makes sense and sets up the appearance with you. Continuances are handled with the District Attorney’s Office in writing, and the stipulation goes to the court before the date. You are told in advance which dates the court will want you in the courtroom.

Discovery and video are requested before the first substantive setting. If a felony is bound over, the case stays in the same building, before the district court, and the work done for the preliminary hearing carries into it. And if a misdemeanor ends in a conviction, an appeal to the district court has to be filed within 10 days of the judgment and is decided on the record made in East Fork, so if one is possible, it is planned before the sentencing date.
